Regarding the visited online store https://www.swingy.net and the purchase of products on it, it is established that:
Provider of the Online Store or Seller
The general terms and conditions are drafted in accordance with consumer protection regulations, based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic business transactions. The online store Swingy (hereinafter referred to as the “online store”) is managed by Swingy d.o.o., a provider of electronic business services (hereinafter referred to as the “Merchant”).

By registering in the online store, the visitor acquires a username, which is identical to their email address, and a password chosen by the user. The username and password unambiguously identify and connect the user with the provided data. By registering, the visitor confirms and guarantees that they are of legal age and have full business capacity. Upon registration, the visitor becomes a user and gains the right to purchase. By purchasing a product, the user becomes a buyer.
These General Terms and Conditions define the operation of the online store, the rights and obligations of the visitor, user, and buyer, as well as the business relationship between the Merchant and the user as the buyer of the products offered in the online store.
1. Introduction – Definitions of Terms
Swingy d.o.o. (hereinafter referred to as the “Company”) is the developer and provider of its own online store https://www.swingy.net (hereinafter referred to as the “online store”) and the seller of products offered on it.
General Terms and Conditions of the online store https://www.swingy.net (hereinafter referred to as “General Terms and Conditions”) regulate the conclusion of distance contracts with consumers via the internet, in accordance with the Consumer Protection Act, the Electronic Commerce Market Act, and the Electronic Communications Act. These terms represent an information society service and require the Company to provide consumers with the information contained herein. The latest version of these General Terms and Conditions is permanently available at https://www.swingy.net/terms.
Visitor of the online store (hereinafter referred to as the “user” or “visitor”) is a person who visits or navigates through the online store and its subpages.
Purchase is the conclusion of a distance contract for the purchase of selected products by placing an online order at the published price and in accordance with the terms and conditions valid at the time of placing the order.
Consumer is, according to the Consumer Protection Act, a natural person who acquires or uses goods and services for purposes outside their professional or business activities.
Buyer is a user who has successfully completed a purchase in the online store. If the buyer does not meet the definition of a consumer (e.g., a purchase is made by a legal entity), the Company is not obliged to provide the guarantees granted by these General Terms and Conditions to consumers.
2. Availability of Information
The Merchant undertakes to always provide the user with the following information:
Data on the identity of the Merchant (especially company name, registered office, and registration number). Contact details enabling quick and efficient communication with the Merchant (email address, phone number, etc.). Information on the essential characteristics of products or services offered in the online store, including after-sales services and warranties. Information on the availability of products or services from the online store’s offer. Methods and conditions of product delivery or service execution, particularly the location and delivery timeframe. Information on payment methods. Information on the validity period of offers in the online store. Information on the withdrawal period and conditions for withdrawal from the contract. Information on the possibility of returning products and any associated costs for the user. Information on the complaint procedure and contact details of the Merchant’s complaint handling personnel.
3. Prices
All prices in the online store are stated in euros (EUR) and include VAT, unless explicitly stated otherwise. All prices in the online store are product prices and do not include delivery costs (see point 3). All prices apply exclusively to electronic orders placed through the online store. Prices are valid at the time of placing an order and are not predefined, meaning they apply until they are changed. Despite all efforts to provide the most accurate and up-to-date information, pricing errors may occur.
4. Purchase Process
4.1. Order Received
After placing an order, the user (buyer) receives an email notification from the Merchant confirming that the order has been received. The user (buyer) can always access comprehensive information about the status and content of their order within their profile on the Merchant’s website.
4.2. Order Confirmation
If the user (buyer) does not cancel the order, it proceeds to processing. The Merchant reviews the order, checks product availability, and either confirms or rejects the order with a valid reason. The Merchant may contact the user (buyer) via phone or other authorized means to verify details or ensure accurate delivery.
Upon confirming the order, the Merchant notifies the user (buyer) via email about the expected delivery time. At this stage, the purchase contract is irrevocably concluded (see point 6).
4.3. Order Dispatched
The Merchant prepares and ships the ordered products within the agreed timeframe. In the confirmation email, the Merchant also provides information on the return policy and introduces the user (buyer) to customer service contacts in case of complaints or delivery delays.
5. Purchase Agreement
The Merchant issues an invoice in written form to the user who purchases a product from the online store, including a breakdown of costs and an explanation of the right to withdraw from the purchase if necessary.
The purchase contract in the form of an order is electronically stored on the Merchant’s server and is available to the user (buyer) at any time within their user profile.
From this point on, all prices and other purchase conditions are fixed and apply equally to both the Merchant and the user (buyer).
6. Right to Withdraw from the Purchase – Product Returns
The user (buyer) has the right to withdraw from the purchase within 30 days of receiving the ordered products. To do so, they must contact the Merchant via info@swingy.net and inform them of their decision to withdraw from the purchase contract, without the need to provide a reason. The return of purchased products to the Merchant within the withdrawal period is considered a withdrawal notification. The only cost borne by the user (buyer) in the event of withdrawal is the cost of returning the products to the Merchant.
Returned products must be sent back to the Merchant immediately, or at the latest within 30 days from the date of withdrawal notification. The products must be returned undamaged and in their original quantity, unless the products have been destroyed, damaged, lost, or their quantity has decreased without fault of the user (buyer).
For returned products, the Merchant will refund the amount paid as soon as possible, but no later than 14 days after receiving the withdrawal notification. The refund will be issued using the same payment method used by the buyer unless explicitly requested otherwise.
7. Warranty for Technical Goods
A product is covered by a warranty if stated on the warranty certificate or invoice. For a product issued with a warranty, the seller guarantees the product’s flawless operation, provided the warranty conditions are met and within the warranty period. When claiming the warranty, the warranty conditions stated on the warranty certificate included with the product apply. The seller guarantees the flawless operation of the product for the warranty period, starting from the date of delivery to the buyer. The standard warranty period is one year unless specified otherwise on the warranty certificate. The warranty can be claimed using the warranty certificate or invoice, which the buyer should keep safely.
If a product with a mandatory warranty does not function properly or lacks the properties stated in the warranty certificate or advertising message, the buyer can request the correction of defects under the Consumer Protection Act. The seller commits to repairing product defects at no cost to the buyer within 45 days from receiving the defective product. If the product is not repaired within 45 days, the seller must replace it with a new, identical, and flawless product. If the seller does not repair or replace the product within the given period, the buyer has the right to withdraw from the contract and request a full refund.
The warranty covers defects in materials and workmanship and applies to all product components except consumables. The warranty becomes void in cases of:
- Improper use not following the provided instructions.
- Improper installation or maintenance.
- Damage caused by misuse, negligence, mechanical damage by the buyer, or force majeure (power surge, lightning, etc.).
- Unauthorized tampering with the product by the buyer or an unauthorized service provider.
- Connection to an incorrect voltage or power source.
- Use of non-original components not intended for the product.
If a warranty claim is made, the seller will inspect whether the defect is due to material or manufacturing faults. If the defect is confirmed, the product will be repaired or replaced under warranty. However, if the defect is due to wear and tear, improper use, or physical damage, the warranty claim will be rejected. To claim the warranty, the buyer must visit the seller or an authorized service provider listed on the warranty certificate with the product and original documentation. The warranty rights do not affect the consumer’s statutory rights concerning product defects.
8. Satisfaction Guarantee and Insurance
We are committed to the highest ethical standards in business and consumer protection, including our 100% satisfaction guarantee.
Under the conditions specified below, we offer a 30-day (or 60-day, if the buyer has purchased this option) satisfaction guarantee. This allows the buyer to return purchased products even after the standard 14-day withdrawal period. The buyer can return the products by sending them back to Swingy d.o.o., Topniška ulica 4, 1000 Ljubljana, Slovenia. A full refund of the product price will be issued, excluding shipping and return costs, provided all conditions below are met.
To claim the satisfaction guarantee, the buyer must fill out an online request form specifically for this purpose. Submitting this form is the only valid way to initiate a satisfaction guarantee claim. No other form of communication regarding the claim will be accepted.
Products eligible for the satisfaction guarantee are visibly marked in the online store. If the buyer is dissatisfied with their purchase, the seller will refund the full purchase amount within 30 days (or 60 days if the extended option was purchased) from the date of the claim. The only cost borne by the buyer is the return shipping fee.
The satisfaction guarantee applies for 30 days (or 60 days if the extended option was purchased) from the date of receipt for one month’s supply of products per person. If the buyer purchased a multi-month supply, they can still receive a refund, but they must return all unused products in original packaging and provide proof of purchase.
The satisfaction guarantee can only be claimed once per year for the same product and up to three different products per year per buyer. These conditions apply to both 30-day and 60-day return policies.
The seller guarantees that products will function as intended if used according to the provided instructions. This is the basis for the satisfaction guarantee. For more details on the return process, contact info@swingy.net.
If the buyer has purchased shipping insurance and the delivered products (or packaging) arrive damaged, the buyer is entitled to receive a replacement shipment at no extra cost, without having to provide further proof of damage. The buyer can submit a claim by sending a photo of the damaged products or packaging to info@swingy.net.
9. Order Processing and Delivery
The seller will deliver ordered products to the buyer within the agreed timeframe. The seller’s contracted delivery partners are specified at checkout.
If the buyer notices visible damage to the packaging or products, they must immediately file a claim with the seller or the delivery service upon receipt. The buyer is not obligated to accept damaged shipments and may reject the package. If the package is physically damaged, missing contents, shows signs of tampering, or contains damaged products, and the buyer has accepted it, they must initiate a complaint process with the seller.
10. Security
The seller uses appropriate technological and organizational measures to protect the transfer and storage of personal data and payments. A 256-bit SSL certificate, issued by an authorized organization, is used for data encryption.
Secure credit card authorization and transactions are handled by certified online payment systems, ensuring real-time authorization and immediate verification of payment details with banks. The seller does not store credit card information on its servers.
The buyer is also responsible for security by keeping their username and password confidential and ensuring their computer has adequate antivirus protection.
11. Privacy Policy
The seller’s Privacy Policy is an integral part of these General Terms and Conditions and is available here.
12. Liability
The seller strives to ensure the accuracy and timeliness of the information published in the online store. However, product specifications, delivery times, and prices may change faster than the seller can update them.
Although the seller aims to provide accurate product images, all images are symbolic and may not exactly match the product’s features.
13. Changes to General Terms and Conditions
The seller may modify or supplement these General Terms and Conditions due to regulatory changes related to e-commerce, data protection, and other relevant business aspects. Users will be notified of changes through the seller’s website.
Any modifications to the General Terms and Conditions become effective eight days after publication. If the changes are necessary to comply with laws, they may take effect immediately.
If a user disagrees with the changes, they must cancel their registration within eight days of the announcement. If they do not cancel within this period, they are considered to have accepted the changes, and any objections will not be considered. Cancellation of registration must be submitted in writing to the seller.
